1.1 This AIC establishes the procedures for air operators to apply for an extension of Air Traffic Services (ATS) operating hours beyond the operating hours published in the Aeronautical Information Publication Malaysia (AIP Malaysia). The procedure is intended to meet operational demand, particularly for domestic passenger flights that require ATS services outside published operating hours.

1.2 The provision of ATS beyond the published operating hours is subject to operational feasibility, availability of qualified personnel and supporting services, compliance with applicable duty period and fatigue management requirements.

1.3 An extension of ATS operating hours is not automatically granted upon submission of an application. CAAM reserves the right to approve, approve with conditions, amend or reject an application based on operational, safety, regulatory and resource considerations.

1.4 Air operators shall comply with the applicable eligibility, submission and operational requirements specified in this AIC.

2.1 The purpose of this Aeronautical Information Circular (AIC) is to:

1. establish and standardise the procedures for applying an extension of ATS operating hours;

2. define the requirements and submission timelines for each category of application;

3. ensure timely and effective coordination among CAAM, ATS Units (ATSUs), air operators, aerodrome operators and other relevant stakeholders; and

4. ensure that extensions are safe, operationally feasible and compliant with ATCO duty and fatigue-management requirements.

3.1 This procedure applies to eligible commercial passenger air services operators specified in Section 4 when applying for the provision of ATS outside the operating hours published in the AIP Malaysia.

3.2 For the purpose of this AIC, extension applications are categorised as follows:

1. Pre-planned Extension Application — a complete application to be submitted at least 45 days before the scheduled date of operation;

2. Ad-Hoc Extension Application — an application arising from an urgent or unforeseen operational situation.

3.3 General Aviation (GA) operations are outside the scope of this AIC.

4.1 Applications may only be submitted by a commercial passenger air service operator that holds either:

1. a valid Malaysian Air Service License (ASL), Air Operator Certificate (AOC) and applicable Air Traffic Right; or

2. a foreign scheduled air service operator that is duly designated or authorised under the applicable Air Services Agreement and holds a valid Malaysian Foreign Air Operator Certificate (FAOC).

4.2 Submission or approval under this AIC relates solely to the extension of ATS operating hours and does not constitute an application for or approval of any flight or landing permit. An air operator conducting an additional frequency, extra flight or ad-hoc flight shall separately obtain the applicable approval or permit through AeroFile, NOSAS or any other CAAM recognised system before operating the flight.

4.3 For an application under paragraph 3.2 (a), the air operator shall submit this application to obtain CAAM’s pre-approval for the extension of ATS operating hours before submitting its slot application to National Slot Coordination Malaysia (NSCM). Such pre-approval does not guarantee the allocation of a slot by NSCM. Upon the air operator obtaining the applicable NSCM slot confirmation and CAAM flight approval or landing permit issued through AeroFile, NOSAS or any other system recognised by CAAM, the pre-approval shall automatically become final approval.

4.4 For an application under paragraph 3.2 (b), the air operator shall confirm in the application form that:

1. all applicable flight permissions, permits and regulatory approvals have been obtained and remain valid;

2. where a landing permit is required, a valid permit has been issued through AeroFile, NOSAS or any other system recognised by CAAM;

3. prior approval or confirmation has been obtained from the aerodrome operator; and

4. coordination and approval from all relevant agencies have been obtained if applicable.

4.5 An application may be rejected or returned without further processing where:

1. the application is incomplete or contains inaccurate information;

2. the required supporting documents are not provided;

3. the required confirmation from the aerodrome operator or relevant agencies has not been obtained; or

4. the application does not comply with the prescribed submission timeline.

5.1 Pre-planned Extension Application.

5.2 Ad-Hoc Extension Application

6.1 The application must be completed, accurate and supported by the required documents at the time of submission.

6.2 The time of submission shall be determined based on the time at which CAAM OCC receives the complete application and all required supporting documents.

6.3 An incomplete application shall not be considered to have met the prescribed submission timeline.

6.4 CAAM may request for further information or clarification. If it is not provided within the specified period, the application may be rejected or closed without approval.

7.1 Each request shall be assessed by CAAM on a case-by-case basis, taking into consideration safety, operational feasibility and compliance with applicable regulatory requirements. The submission of a request does not confer any entitlement to approval and CAAM reserves the right to approve or reject any request at its sole discretion any other safety or operational consideration determined by CAAM.

7.2 Approval shall only apply to the flight, date, aerodrome and operating times stated in the approval notification.

7.3 An approved extension shall not establish a permanent amendment to the operating hours published in the AIP Malaysia.

7.4 Approval granted under this AIC is limited solely to the provision of ATS outside the operating hours published in AIP Malaysia. It shall not constitute or replace:

1. a flight, landing or overflight approval issued through AeroFile, NOSAS or any other system recognised by CAAM;

2. an Air Traffic Right or variation thereof;

3. slot confirmation by NSCM;

4. approval for the extension of aerodrome operating hours; or

5. approval or confirmation from any other supporting agency.

7.5 CAAM may withdraw or amend an approval where:

1. ATS resources become unavailable;

2. the aerodrome operator or supporting agency withdraws its approval;

3. the operator changes the approved schedule;

4. safety or operational conditions deteriorate;

5. the information provided by the operator is found to be inaccurate; or

6. the conditions of approval are not complied with.

8.1 The air operator shall be responsible for:

1. submitting a complete and accurate application within the prescribed timeline;

2. declaring prior approval or confirmation from the aerodrome operator;

3. coordinating with other agencies, where applicable;

4. coordinating with ground handling agents, rescue and fire-fighting services, security agencies, fuelling providers and other supporting services;

5. declaring the applicable landing permit and regulatory approval;

6. ensuring the validity of its ASL or FAOC and other applicable approval;

7. complying with all conditions imposed by CAAM;

8. adhering to the approved operating schedule;

9. promptly notifying CAAM of any delay, amendment or cancellation; and

10. disseminating the approval, rejection, amendment or cancellation to all relevant stakeholders.

8.2 Coordination undertaken by CAAM OCC for the provision of ATS shall not relieve the air operator of its responsibility to coordinate with the aerodrome operator and other agencies.

9.1 Where an approved extension is no longer required, the air operator shall notify CAAM OCC and all relevant stakeholders immediately.

9.2 The cancellation notification shall include:

1. reference number of the approval;

2. flight number;

3. date and approved operating time;

4. reason for cancellation; and

5. name and contact details of the person submitting the cancellation.

9.3 The operator shall not assume that cancellation notified only to the aerodrome operator, ground handler or another agency has been received by CAAM.

9.4 Repeated late cancellations, failure to notify CAAM or failure to utilise approved extensions may be taken into consideration when assessing future applications.

10.1 The operating hours of CAAM OCC for processing extension applications are: 0900 to 2300 Local Time (LT) or 0100 to 1500 Coordinated Universal Time (UTC) daily.

10.2 Applications submitted outside CAAM OCC operating hours shall be treated as received at the commencement of the next OCC operating period.

10.3 An application submitted outside OCC operating hours may not be processed where the applicable minimum notification period cannot be met.

11.1 The Extension of Air Traffic Services Operating Hours Application Form is available on the CAAM website under: E-Services & Forms → Operation Control Centre.

11.2 Air operators shall ensure that the latest version of the application form is used.

11.3 Use of an obsolete form may result in the application being returned for correction.

14.1 This AIC revokes and supersedes AIC 01/26 — Establishment of Procedures for the Extension of Air Traffic Services Operating Hours upon Request from Air Operators — with effect from the effective date of this AIC.

14.2 Any approval issued under AIC 01/26 before the effective date of this AIC shall remain valid until its expiry, unless amended, withdrawn or cancelled by CAAM.
