ENR 1.2  VISUAL FLIGHT RULES

1.2.1  Introduction

1.2.1.1 An aircraft intending to operate under VFR within the Kuala Lumpur FIR and Kota Kinabalu FIR shall comply with the flight visibility and clearance from cloud criteria contained in the table in ENR 1.4.
1.2.1.2 An aircraft operated in accordance with the visual flight rules which wishes to change to compliance with the instrument flight rules shall:

  1. if a flight plan was submitted, communicate the necessary changes to be effected to its current flight plan, or

  2. when so required by para 1 (ENR 1.10 FLIGHT PLANNING) submit a flight plan to the appropriate air traffic services unit and obtain a clearance prior to proceeding IFR when in controlled airspace.

1.2.2  Flights Outside Controlled Airspace

1.2.2.1 When flying VFR outside controlled airspace a pilot shall comply with the following:

  1. when flying at or above 10,000ft. above mean sea level shall remain at least 1500 metres horizontally and 1,000ft. vertically clear of cloud and in a flight visibility of at least 8 kilometres; or

  2. when flying below 10,000ft. above mean sea level shall remain at least 1500 metres horizontally and 1,000ft. vertically clear of cloud and in a flight visibility of at least 5 kilometres;

    provided that this item shall be deemed to be complied with if:

    1. the aircraft is flying at or below 3,000ft. above mean sea level and remains clear of cloud and in sight of the surface and in a flight visibility of at least 5 kilometres; and

    2. in the case of a helicopter, the helicopter is flying at or below 3,000ft. above mean sea level flying at a speed which having regard to the visibility is reasonable, and remains clear of cloud and in sight of the surface.
