GEN 1.6  SUMMARIES OF NATIONAL REGULATIONS AND INTERNATIONAL AGREEMENTS / CONVENTIONS

1.6.1. The following is a list of civil aviation legislation, air navigation regulations, air navigation orders etc. in force in Peninsular Malaysia and Sabah and Sarawak (East Malaysia). It is essential that anyone engaged in air operations in these territories be acquainted with the relevant regulations.

1.6.3. The following is a list of plant quarantine legislation and international agreements / conventions that are in force:
  1. Plant Quarantine Act 1976

  2. Plant Quarantine Regulations 1981

  3. Customs Order (Prohibition of Imports and Exports) 1988

  4. International Plant Protection Convention

  5. Convention in International Trade on Endangered Species of Fauna and Flora (CITES)

1.6.4. Terms for the validation of a non-Malaysian pilot licence from an ICAO contracting state.
1.6.4.1 The validation of non-Malaysian professional pilot’s licence.
1.6.4.1.1 The Certificate of Validation is issued by Civil Aviation Authority of Malaysia in accordance with the provisions of the Civil Aviation Regulation 2016. A pilot’s licence issued by an ICAO Contracting State is considered to have the same validity as if the licence has been granted under the Malaysian Regulation. The holder is also considered to have satisfied the medical standards appropriate to the class of the foreign pilot’s licence held.
1.6.4.1.2 A Certificate of Validation may be issued under one of the following circumstances:
  1. A visiting pilot who wishes to carry out non-commercial flights in a Malaysian registered aircraft for a short duration. (PPL privileges)

  2. The holder of a valid foreign licence undergoing training sponsored by a Malaysian Air Operator to obtain a Malaysian Professional Pilot’s Licence (line training on public transport flights are not permitted for this purpose).

  3. The holder of a valid foreign professional pilot’s licence carrying out an overseas ferry/delivery flight on behalf of Malaysian operator.

  4. An Authorise Examiner who is a holder of a valid foreign professional pilot’s licence to carry out flight test on behalf of Civil Aviation Authority of Malaysia for an aircraft type rating endorsement.

1.6.4.1.3 Civil Aviation Authority of Malaysia would normally validate a pilot’s licence for a period of the validity of the foreign licence or not exceeding a period of six months.
1.6.4.1.4 A Flying Instructor’s Rating endorsed in a non-Malaysian licence may not be issued with a Certificate of Validation unless the applicant passes a practical flight test by a Civil Aviation Authority of Malaysia Authorised Examiner.
1.6.4.1.5 The Certificate of Validation will be endorsed with limitations if Civil Aviation Authority of Malaysia feels necessary.
1.6.4.1.6 The holder of any expired pilot’s licence is not eligible to apply for the Certificate of Validation.
1.6.4.1.7 A non-Malaysian licence holder seeking regular employment as an aircrew on Malaysian registered aircraft would not be issued with a Certificate of Validation unless he/she meets the terms for conversion of non-Malaysian professional pilot’s licence as specified in Flight Operations Circulars and Notices, Notice Number 3.
1.6.4.1.8 For the purpose of applying for a Certificate of Validation, a foreign pilot licence’s holder must meet the following requirement:
  1. a valid Medical Certificate

  2. a valid Radio telephony Operator’s Licence

  3. a valid Certificate of Test / Aircraft Rating

  4. a valid Instrument Rating (if applicable)

  5. a valid Instructor’s Rating (if applicable)

Note: The above Certificates / Ratings must be issued by a single licensing authority. A combination of Certificates / Ratings issued by different authorities cannot be accepted for the application of Certificate of Validation.
